The conditions set out herein are agreed between Torrefação de Manuel Lapa, Lda., NIPC no. 501787461 and head office at Rua Monte de Além, 265, 4410-268, Canelas, Vila Nova de Gaia, hereinafter referred to as "Beira Douro Cafés" and the user of the Online Shop www.beiradouro-cafes.pt (hereinafter referred to as "Online Shop"), who wishes to make a purchase through it, hereinafter referred to as "Customer".

1. GENERAL CONDITIONS OF SALE

1.1 By placing an order, the Customer acknowledges that he/she has read, understood and unreservedly accepts these Terms & Conditions of Sale, the privacy policy and the cookie policy of the Online Shop.

1.2 By using the Online Shop, you accept and agree to be bound by our Terms of Use and Internet Privacy Policy (privacy terms).

1.3 All products are the property of Beira Douro Cafés, until confirmation of good collection of the total amount of each order.

1.4. Beira Douro Cafés has the right to unilaterally modify these Conditions of Sale and the product catalog at any time and without prior notice.

1.5. The Customer shall at all times be bound by the conditions in force at the time of placing the order.

2. REGISTRATION AND PASSWORD

2.1. Customers wishing to place an order must register by filling in all the information on the form correctly and completely and accept the data processing conditions in accordance with these policies.

2.2 By accessing the Online Shop and entering their details (username and password), the Customer is declaring that the information and statements they provide are their own. The use of said data (username and password) will serve as a means of verifying their authorship and the integrity of the operations carried out by the Customer in the Online Shop.

2.3 If the Customer has forgotten his password, he should click on the "recover password!" box, enter his e-mail address and his password will be sent to the Customer's e-mail address.

2.4 Customers only need to register once and must update their details whenever necessary. After registering, you can start shopping immediately. Please consult our Privacy Policy

2.5. The Customer undertakes to make diligent use of and keep secret the access code and Customer name assigned, and any misuse by third parties and any damage that may result shall be the responsibility of the Customer.

3. ORDERS, NOTICES AND CONFIRMATIONS

3.1. When placing an order through the Beira Douro Cafés Online Shop, the Customer makes an offer to buy the products they have selected.

3.2 Orders placed for Capsules only (intense ; smooth and Decaf of 10units) are subject to minimum quantity limits of 40 capsules (4 boxes) per purchase.

3.3 The Customer may combine the capsule varieties (intense, smooth and Decaf 10-pack), provided that the total number is at least 4 10-pack boxes.
(Ex: 2 cx of Intense + 2cx of Smooth)

3.4 If the customer adds a product other than capsules, this limit no longer applies.
(Ex: 1 Tea + 1cx Smooth)

3.5. The Customer places the order by selecting products from the catalog available in the online store.

3.6 To finalize your order, the Customer must provide the following information, logging in with their e-mail address and password:
- Elements essential to the processing and dispatch of your order (Billing Data, Delivery Method, Payment Method).

3.7 As soon as Beira Douro Cafés receives an order from the Customer exclusively electronically, it will acknowledge receipt of the order by sending an email containing the order identification to the email address indicated by the Customer.

3.8 If, after checking that stock is available and confirming that the full amount of the order has been paid, an anomaly is found, the Customer will be informed of this by e-mail.

3.9. If the product is unavailable, Beira Douro Cafés undertakes to inform the Customer of this fact and to reimburse the amounts paid within a maximum of 30 days from the date of knowledge of the unavailability.

3.10. All products are the property of Beira Douro Cafés, until confirmation of good collection of the total value of each order.

3.11. Beira Douro Cafés will execute orders received through the online store according to available stocks and after confirming receipt of payment, and undertakes to fulfill the order no later than 30 days from the day following its conclusion.

4. PRICES AND SHIPPING COSTS

4.1. The prices of the items are those displayed in the Online Shop on the date the order is placed, including VAT.

4.2. The Customer will pay a fee corresponding to the order processing and shipping service, debited according to the values indicated in the Online Shop and calculated, in particular, according to the size, weight and place of delivery of the order.

4.3 Beira Douro Cafés will cover the cost of shipping fees for orders over €50 (total value of the order), with delivery in mainland Portugal (order delivery address).

4.4 Beira Douro Cafés reserves the right to change its prices and shipping costs at any time and to cancel a contract if there are errors in writing, printing or calculation.

5. PROMOTIONAL CAMPAIGNS, COMPETITIONS AND SPECIAL OFFERS

5.1. Beira Douro Cafés reserves the right, whenever it deems it appropriate, to carry out promotional campaigns and offers, considered only for orders through the online store, and within the framework and conditions that they apply. The values corresponding to campaigns and promotional offers will only be valid for the duration of said campaigns and promotional offers.

5.2 All products covered by the offers and campaigns are subject to stock limitations existing at the time.

6. PAYMENTS

6.1 Payments for orders can be made by ATM, credit card - through the EasyPay system, one of the simplest, fastest and most secure systems for making online payments - or bank transfer.

6.2 - EasyPay - Multibanco - payment can be made at Multibanco ATMs or via "Home Banking", in the services payment area, using the entity, reference and amount presented after completing the purchase process;

6.3 - EasyPay - Credit card - payment can be made using Visa and Mastercard credit cards, and can be used both nationally and internationally.

6.4 Payment details will be managed by Easypay

6.5 Any claims made by the customer do not give the customer the right to suspend or defer part or all of the outstanding payment, nor to make any compensation to the customer's benefit.

7. DELIVERIES AND ORDER VERIFICATION

7.1 The goods ordered will be delivered by a service provider who delivers the orders on behalf of Beira Douro Cafés.

7.2 Orders can be shipped to mainland Portugal, but home delivery cannot be made to PO boxes.

7.3 Orders will only be shipped after confirmation of stock and payment, and will be dispatched by a Beira Douro Cafés partner company that specializes in this type of service.

7.4 Orders will be delivered to the address indicated by the Customer when placing the order. It is the Customer's full responsibility to ensure that the delivery address is correct and complete and to ensure that it is available for reception.

7.5 Once collection has been verified, the order will be prepared and delivered to the carrier within 48/72 working hours.

7.6 Upon receipt of the order, the Customer must check that it corresponds to the quantities and that it is in perfect condition.

7.7 Without prejudice to the Customer's rights under the law, if the Customer notices any anomaly, such as damage or missing items, when the order is delivered, the Customer must inform and lodge a complaint with the carrier and contact Beira Douro Cafés within 7 days of the delivery date.

8. RETURNS / EXCHANGES

8.1. The Customer has a period of 14 days from the day of receipt of the product to withdraw from the contract, without payment of compensation and without giving any reason.

8.2 The Customer wishing to terminate the contract must express this intention by sending a declaration similar to the one below, by email or letter to the contacts indicated, or by any other unequivocal declaration of termination of the contract. -

I/we hereby give notice that I/we are withdrawing from my/our contract of sale for the following goods/for the provision of the following service

8.3 In the event that the customer exercises the right of withdrawal, Beira Douro Cafés will reimburse within 14 days the amounts paid by the Customer, including the costs of delivery of the goods, except for any expenses directly arising from the return of the goods.

8.4 Beira Douro Cafés may withhold reimbursement until it has possession of the returned goods.

8.5 You must return the goods within 14 days of the day on which you gave notice of withdrawal from the contract. The deadline is deemed to have been met if you return the goods before the expiry of the 14-day period. The return shipping costs will be borne by the customer.

8.6 The Customer must return the goods without any depreciation resulting from handling that exceeds what is necessary to verify their good state of consumption / use.

9. RESPONSIBILITY

9.1 Except in cases of intent or serious fault, the Customer may not demand compensation from Beira Douro Cafés in excess of the purchase price of the products that caused the damage to be compensated.

9.2 Under no circumstances shall Beira Douro Cafés be held liable for any indirect or consequential damages of any nature whatsoever in connection with the use of the products presented in the online store.

9.3 Any and all liability for any loss or damage that the customer may suffer as a result of breach of the terms and conditions presented is expressly excluded.

10. MISCELLANEOUS PROVISIONS

10.1 The parties agree that their relationship shall be governed exclusively by this contract.

10.2 Should any of the provisions of these conditions be declared null and void, such nullity shall not affect the validity of the remaining conditions, which shall continue to be complied with by the parties.

11. DURATION AND TERM

11.1 Beira Douro Cafés may cease, suspend or interrupt, at any time and without prior notice, the provision of the online store service and/or any of the services and functionalities contained therein.

12. APPLICABLE LAW AND JURISDICTION

12.1 The conditions of the online store are governed by Portuguese law.

12.2 Any dispute between the parties regarding the interpretation or application of this contract shall be submitted to the Portuguese Courts with territorial jurisdiction, expressly waiving any other.

13. DISPUTE MANAGEMENT

13.1 In the event of a dispute, the consumer may contact a Consumer Dispute Resolution Body, available at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=EN, or to the following alternative dispute resolution bodies:
