01. Background

These General Terms and Conditions of Sale (“Terms and Conditions”), which form an integral part of the Terms and Conditions of the website www.beiradourocafes.pt (“Online Shop”), set out the rules governing the purchase of products sold by Torrefação de Manuel Lapa Lda, hereinafter referred to as “Beira Douro cafés”, a limited liability company with company registration number 501787461, with its registered office at Rua Monte de Além, 265, 4410-268 Canelas, Vila Nova de Gaia, Portugal. For the purposes of these Terms and Conditions, the following definitions shall apply: “User”: Any natural or legal person accessing the Website; “Customer”: Any natural or legal person who registers on the Website and places an Order via the Online Shop. By placing an Order via the Online Shop, in accordance with these Terms and Conditions, the Customer enters into a contractual commitment with Beira Douro cafés, thereby becoming a Party to a contract of sale governed by Portuguese law and drawn up entirely in the Portuguese language. If you wish to order products via the Online Shop, you must read these Terms and Conditions, the Privacy Policy and the Cookies Policy carefully and expressly accept them in the place indicated. You must not proceed with any Order if you do not understand or do not accept these Terms and Conditions, as well as the other supporting legal documentation. 02. Scope of the Contract

These Terms and Conditions constitute a legally binding contract (“Contract”) between the Customer and Beira Douro cafés, governing the purchase of products available in the Online Shop. Beira Douro has developed this Website for the purpose of promoting and marketing its products. The purchase of products via the Online Shop is available to Customers aged 18 or over who have full legal capacity to be a Party to the Contract under applicable law. The Contract is deemed to have been concluded upon receipt of written confirmation of the Order sent by Beira Douro cafés. Actual delivery of the goods is, however, subject to confirmation of full payment and verification that the selected products are physically in stock.

03. Ordering Process

a) Steps for placing an order:

To place an order via the Online Shop, the Customer must follow these steps: Log in or complete the mandatory account registration in the members’ area of the website; Browse the catalogue, select the desired products and add them to the shopping basket; Provide the necessary details accurately for invoicing, dispatch and delivery of the Order; Review the Order summary, checking the prices, quantities, estimated delivery costs and times, and the selected payment method; Complete the order and pay the total amount using your chosen payment method; Await receipt of the order confirmation email, which includes a detailed summary of the purchase. The Customer assumes full responsibility for ensuring that all information provided to Beira Douro Cafés is accurate, complete and up to date. Any inaccuracy in the delivery or billing details that prevents or delays the correct fulfilment of the Contract is the sole responsibility of the Customer. If the Customer does not receive the confirmation email after making payment, this means that the transaction has not been completed correctly due to technical or financial validation issues, and they should contact Beira Douro cafés’ Customer Service immediately.

(b) Product prices and specifications; ;

The prices shown for each item in the catalogue include VAT (Value Added Tax) at the statutory rate in force on the date of purchase. Shipping and delivery charges are added to the price displayed and are calculated transparently before the order is finalised. If the Customer has a promotional code, voucher or discount coupon, they must enter it in the field specifically designated for this purpose during the checkout process; the final price will be updated automatically, provided that the code is valid and applicable to the selected products. Beira Douro cafés is not bound by obvious technical or typographical errors in the prices displayed. Should an Order be placed for an item whose price displays an obvious and flagrant error, Beira Douro Cafés will inform the Customer as soon as possible, giving them the option to reconfirm the Order with the corrected price or to cancel the Contract, with a full refund of any amounts paid in the meantime. The prices, descriptions, packaging and sensory characteristics of the products sold in the Online Shop may be subject to change due to management requirements, changes in stock levels or new market developments. The Customer is strictly bound by the prices and conditions in force on the date on which they place their Order.

c) Horeca carcass cuts:

The coffee bean batches intended for business and commercial consumption within the ‘Mestre’ range (namely the Essence, Premier, Infante and D.Luiz batches) are intended exclusively for the HORECA sector and for contractual supply on a volume or loan basis. These batches are displayed on the website without any indication of a direct online sale price. Users interested in making a commercial purchase or arranging technical support for their premises should submit the relevant contact form or request, via the designated section, a face-to-face visit from a Beira Douro Cafés sales consultant to receive a personalised quote.

d) Order cancellation:

Without prejudice to the exercise of the right of withdrawal, the Customer may request the free cancellation of their order directly by email or telephone, within a strict time limit of 90 minutes after payment has been processed. After this deadline, the Order enters the logistics processing stage and is physically prepared for dispatch in the warehouse, making it impossible to cancel it administratively.

 

04. Delivery Terms and Costs

Deliveries of orders placed via the Beira Douro Cafés Online Shop are handled and distributed by our partner courier, CTT Expresso / MRW / Batch, in mainland Portugal and the Autonomous Regions, in accordance with the following rates and delivery timeframes (prices include VAT):

Note: Estimated delivery times may be subject to slight delays during seasonal periods of high demand (such as Black Friday, Christmas or exclusive anniversary promotions). Beira Douro Cafés is committed to making every logistical effort within its power, in collaboration with its transport partners, to ensure that the aforementioned delivery times are met.

05. Payment Methods

To ensure maximum reliability and transaction integrity, Beira Douro Cafés offers the following secure payment methods on its e-commerce platform:

- MB WAY: The Customer enters the mobile phone number linked to their MB WAY account and has a time limit of 5 minutes to expressly authorise the corresponding debit via their bank’s app or the MB WAY app. Once this time limit has expired, the transaction expires and the Order is cancelled;

- Multibanco reference: The payment details (Payee, Reference and Total Amount) are sent by email and displayed on the screen. The Customer has a maximum of 2 (two) days to make the payment at an ATM or via their online banking service (Payments > Pay for Purchases). If payment is not made within this period, the Order will be cancelled;

Credit cards (Visa / MasterCard): Secure processing involving the entry of card details, with the total amount debited once the order has been validated by the payment gateway;

Bank Transfer: The transaction will remain on hold (“Pending confirmation”) until the corresponding bank has validated the confirmation of successful collection.

06. After-Sales Rights, Returns and Guarantees

(a) Right of Withdrawal (Cancellation)

Under Decree-Law No. 24/2014 of 14 February, a Customer acting as an end consumer has the right to withdraw from a distance contract at their discretion, without having to give a reason, within 14 (fourteen) consecutive days, from the date on which you (or a third party designated by you) take physical possession of the products ordered.

The Customer may exercise this right by contacting us via email (geral@beiradouro-cafes.pt), using the standard withdrawal form or by expressly stating their decision to withdraw. Returned products must be dispatched within 14 days of such notification, with the Customer being responsible for the return postage costs.

CRITICAL EXCEPTIONS TO THE RIGHT OF RETURN (Health Protection and Food Hygiene):

For obvious reasons relating to the protection of public health, food safety and hygiene, Sealed food products (including coffee capsules and batches of whole or ground coffee) whose packaging has been opened, unsealed or damaged by the Customer after delivery are not eligible for return. The Right of Withdrawal applies solely and exclusively to coffee consumables that retain their factory seal intact, with no signs of tampering or breach.

Once the returned products have been received and checked to ensure they are in good condition at our premises, Beira Douro will refund the Customer for all payments made (excluding return costs and any customs duties or special logistics charges) within a maximum of 14 days, using the same payment method selected for the original transaction.

(b) Statutory Warranty for Consumer Goods

Non-consumable products sold via the Online Shop (such as the Premium French Press or coffee cups) are covered by the statutory warranty against manufacturing defects for a period of 3 (three) years from the date of its physical delivery, in accordance with Decree-Law No 84/2021 of 18 October.

The warranty does not cover faults or cosmetic damage resulting from misuse, negligence, physical breakage caused by dropping the item, or normal wear and tear resulting from everyday use. When making a warranty claim, the Customer must present the relevant purchase receipt.

07. Governing Law and Alternative Dispute Resolution

These General Terms and Conditions of Sale and Purchase and all contracts entered into under them shall be governed by Portuguese Law.

Beira Douro bases its partnerships and service relationships on closeness and integrity. In the event of any queries or disagreements, the Customer should, in the first instance, contact our Customer Support Service by email at geral@beiradouro-cafes.pt. We undertake to review and respond formally to any enquiry within a maximum of 3 working days.

If an agreement cannot be reached directly, the Customer may lodge a formal complaint via the Electronic Complaints Register Platform, available at [www.livroreclamacoes.pt].

In accordance with Article 18 of Law No. 144/2015 of 8 September, please be advised that in the event of a dispute arising from online transactions, consumers may refer the matter to the following Alternative Dispute Resolution (ADR) bodies:

  • CICAP – Porto Consumer Information and Arbitration Centre (Rua Damião de Góis, No. 31 – Shop 6, 4050-225 Porto – Responsible for the Vila Nova de Gaia/Greater Porto region);
  • Other competent consumer dispute arbitration bodies, whose contact details and full list are available on the Consumer Portal.

08. Amendments to the Legal Documentation

Beira Douro reserves the right to amend, in whole or in part, unilaterally and without prior notice, these Conditions, the General Terms and Conditions of the Website, the Privacy Policy and the Cookies Policy. Such amendments shall be deemed applicable and in force immediately upon their official publication on the Website, and shall apply exclusively to transactions initiated after their publication.
